NSW Security Industry Act 1997, Amendment Act 2005
and Regulations 2007
These Acts establish the boundaries for the security industry and because of this, there are some
consequences for you that you must be aware of.
The Act specifies that Security Offi cers must not perform activities for which they are not licensed.
This means that if you are using a dog to patrol without a 1D licence you are contravening
the Act.
The Act clarifies that in order to be eligible to hold a licence; you must not have had a recorded
criminal conviction in the previous ten years, or an unrecorded conviction in the previous
five years.
People who have been dismissed from any police service in any jurisdiction in the previous ten
years are also barred from getting a licence.
Under the Act, a licensed officer must not use the licence for any unauthorised reason. He or she
must produce the licence on demand. All Security Officers are required by the Act to wear their
licence when on duty.
